Pick'em ("we," "our," or "us") operates the Pick'em mobile application and website at pickem.fan (the "Service"). By creating an account or using the Service, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the Service.
You must be at least 17 years old to use the Service. The Service includes simulated sports-betting mechanics (picks against spreads, moneylines, and totals with virtual points only) and is rated accordingly in the app stores. By using the Service, you represent that you meet this requirement.
Pick'em is a free-to-play sports prediction game. Points, balances, streaks, badges, and standings exist only inside the Service. They have no cash value, cannot be purchased, sold, transferred, or redeemed for money or anything of value, and are not a currency.
The Service is not a sportsbook, casino, or gambling operator, and does not accept, hold, or pay out money in connection with any pick, wager display, or league result. Betting lines and odds shown in the Service are used for scoring and entertainment only.
If members of a private league choose to make arrangements among themselves outside the Service, we are not a party to those arrangements, do not facilitate them, and accept no responsibility for them. You are responsible for complying with the laws that apply to you.
You are responsible for your account credentials and for activity under your account. Provide accurate information and keep it current. You may delete your account at any time from your profile settings; deletion takes effect after a short grace period during which you can change your mind.
The game only works if everyone plays it straight. You agree not to: tamper with pick submissions, odds, scores, or standings; exploit bugs to gain points or advantages; use automation, bots, or multiple accounts to manipulate results; or interfere with other users' use of the Service.
We may investigate suspected violations and may correct or void affected picks, points, or standings; suspend or remove accounts from leagues; or terminate accounts — at our discretion and without notice where reasonably necessary to protect the game.
League commissioners can manage league settings, membership, and names. Content you submit (league names, display names, chat messages, avatars) must not be unlawful, hateful, harassing, obscene, or infringe anyone's rights. You grant us a license to host and display that content as needed to run the Service, and we may remove content that violates these Terms.
There is no tolerance for objectionable content or abusive behaviour. Report anything that breaks these rules to support@pickem.fan. We review every report and remove violating content, and the accounts responsible, within 24 hours.
The Service, including its design, code, and branding, belongs to us or our licensors. Team names and logos are the property of their respective owners. Pick'em is not affiliated with, endorsed by, or sponsored by the NFL, NBA, NCAA, or any team or league whose games appear in the Service.
The Service is provided "as is" and "as available." Scores, odds, and schedules come from third-party sources and may be delayed, incomplete, or inaccurate; grading and standings depend on that data. We do not warrant that the Service will be uninterrupted or error-free.
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for loss of points, standings, or league outcomes, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to $50 USD.
We may update these Terms from time to time; the "Last updated" date above reflects the current version, and continued use after changes means you accept them. We may modify, suspend, or discontinue the Service (or any part of it) at any time.
The Service is free today, and carries no advertising and no in-app purchases. We may introduce advertising, or optional paid features such as a purchase to remove it, in the future. If we do, we will update these Terms and our Privacy Policy before the change takes effect, and playing in your leagues will remain free. Nothing of that kind would change Section 3: points would still have no cash value, and would still never be purchasable, transferable, or redeemable for anything.
